Terms of Service

1. Who we are

Pokalab (“Pokalab”, “we”, “us”) operates the website at pokalab.com, the Pokalab web platform, and the Poka Solver desktop application (together, the “Service”).

By creating an account, installing Poka Solver, or purchasing a subscription, you accept these terms. If you do not accept them, do not use the Service.

2. What the Service is

Pokalab is a study tool for poker players. It analyses hand histories you provide, displays population tendencies and game-theory-optimal reference strategies, and lets you run solver computations. Poka Solver is a desktop application for Windows that performs those computations on your own machine.

The Service is an analysis and training tool. It is not a gambling service, it does not take wagers, and it does not play poker on your behalf.

3. Accounts

You need an account to use most of the Service. You must be at least 18 years old, give accurate information, and keep your credentials confidential. An account is personal and individual: you may not share it, resell access to it, or let another person use it. You are responsible for everything done through your account.

We may suspend or close an account that shares access, abuses the Service, attempts to circumvent usage limits, or breaks these terms.

4. Subscriptions, prices and billing

Access is sold as a recurring subscription. Prices, tiers and what each tier includes are shown on the pricing page and are the prices in effect at the moment you subscribe. Subscriptions renew automatically for the same period until you cancel; you can cancel at any time and keep access until the end of the period you have already paid for.

Payments are processed by Lemon Squeezy, LLC, our Merchant of Record. Lemon Squeezy, LLC is the seller of record for your purchase: it handles the transaction, applicable sales tax and VAT, invoicing and refunds, and its own terms and privacy notice apply to the payment itself. We never receive or store your card details.

We may change prices for future billing periods. If we do, we will tell you before the change takes effect, and you may cancel before renewing.

5. Refunds

You may request a full refund within 14 days of a purchase. The details, and what falls outside that window, are set out in our Refund Policy, which forms part of these terms.

6. Licence and acceptable use

While your subscription is active we grant you a personal, non-exclusive, non-transferable licence to use the Service and to install Poka Solver on machines you control, for your own poker study.

You may not:

• resell, sublicense, rent or redistribute the Service or any solver output as a product;
• share your account or licence with anyone else;
• reverse engineer, decompile or attempt to extract the source of Poka Solver or of the solution libraries, except where that restriction is prohibited by law;
• scrape, bulk-download or systematically extract the solution libraries, population statistics or any other data set from the Service;
• use the Service to build or train a competing product, or to operate an automated poker-playing agent (a “bot”);
• attack, overload or attempt to gain unauthorised access to our infrastructure.

We keep all intellectual property in the Service, including the software, the solved strategy libraries, the population data sets and the site content. Nothing here transfers any of it to you.

7. Your responsibility towards the poker rooms you play on

This one matters, so we state it plainly. Every poker room sets its own rules about which software may run while you play, and those rules differ between rooms and change over time. Some rooms prohibit real-time assistance entirely; some restrict database and tracking software; some restrict it only at certain tables or stakes.

It is your responsibility, not ours, to check the terms of the room you play on and to use Pokalab in a way that complies with them. Pokalab is designed for study away from the table. We do not warrant that using it is permitted by any particular operator, and we are not liable for any action a poker room takes against your account, including confiscation of funds.

8. Your data and your hand histories

Hand histories and any other content you upload remain yours. You grant us the licence needed to host, process and analyse them so we can provide the Service, including aggregating them, in a de-identified form, into the population statistics the product is built on. How we handle personal data is described in our Privacy Policy.

You are responsible for having the right to upload what you upload, and for complying with your poker room’s rules about exporting hand histories.

9. Availability, changes and features under development

We work to keep the Service available, but we do not promise uninterrupted service. Maintenance, third-party outages and incidents happen. We may add, change or withdraw features; where a change materially reduces what your subscription includes, you may cancel and ask for a pro-rata refund of the unused period.

Some parts of the Service are explicitly labelled as in development or beta. They are provided as-is, may be incomplete or inaccurate, and may be withdrawn.

10. No guarantee of results

Pokalab provides analysis, statistics and computed strategies. It does not guarantee that you will win money, improve your results, or that any strategy shown is optimal for a given opponent or game. Poker involves risk and variance. Any decision you take at the tables is yours.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost poker winnings, or loss of data. Our total liability arising out of the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot be excluded by law, including the statutory rights of consumers.

12. Suspension and termination

You can stop using the Service and cancel your subscription at any time. We may suspend or terminate access if you break these terms, if a payment fails, or if we are required to by law. If we terminate without cause, we refund the unused part of your current period.

13. Changes to these terms

We may update these terms. The effective date at the top of this page always reflects the current version. If a change materially affects your rights, we will notify subscribers before it takes effect. Continuing to use the Service after that date means you accept the updated terms.

14. Governing law

These terms are governed by the law of France, without prejudice to the mandatory consumer-protection rules of the country where you live.
